Several thousand customers have placed their trust in us and booked many travel services for the 2024 summer season and beyond through our travel agency Flamingo Company Fernreisen (USA-Reisen.de | drive-USA.de | drive-canada.de). This great success now means that we are understandably being contacted by affected customers with questions and requests due to the insolvency application of the FTI Group (FTI Touristik, driveFTI, etc.).

Due to the high volume of inquiries, we sincerely regret that we are currently unable to provide personal and individual assistance to all those seeking advice. For the above reason, we ask you to support us by waiting for information about your booking. All customers will be contacted directly by FTI Touristik or by us - in order of departure date.

Below we have noted down everything we currently know about affected bookings. Please read all of the following content and information very carefully! We have endeavored to describe the current state of affairs to you as accurately as possible and thus answer your many individual questions. Please note that not all of the points mentioned here necessarily relate to your personal booking with us, but only individual topics may apply to you.

About the FTI Group
The day before yesterday, on June 3rd, 2024, the FTI Group filed an application for the opening of insolvency proceedings for various parts of the company (including FTI Touristik, driveFTI, etc.) due to insolvency. Since then, only the insolvency administrator appointed by the local court has the opportunity to make business decisions. For example, payments can only be made or trips canceled with his approval. The intended insolvency proceedings initially say nothing about the future of the company with around 11,000 employees, its possible continued existence or a possible sale or the planned takeover by Certares Holding. It cannot therefore be completely ruled out that booked travel services could also be provided.

The status of your booking(s)
If you do not receive a cancellation message from your contractual partner (e.g. FTI Touristik), your booking is still active and the contract between you and the FTI Group still exists. As of today (June 7, 2024), all trips or travel services with service start dates up to July 5, 2024 have been canceled.
Please note that new bookings or replacement bookings that you make based on your own assessment and evaluation of the situation will result in double bookings unless your original booking has been canceled by the FTI Group.

Your flight booking
You often paid for your flight tickets months ago. The early payment was made to secure your flight booking and to guarantee the agreed flight price and the promised conditions. The tickets were then created at short notice by FTI Touristik. You will then receive your e-tickets together with your other travel documents. Since the ticket was issued and the ticket was paid for to the airline at the same time, we believe that your already paid flight bookings are not at risk. However, we cannot guarantee that the airline will maintain your booking. Please always check the status of your flight booking(s) directly with the airline(s).
According to consistent information from customers and airlines, the bookings are currently still active and the flights can be taken. Cancellation information from the FTI Group no longer automatically leads to cancellation of your scheduled flights, as the technical connection via the reservation systems between FTI Touristik and the airlines is currently interrupted. If you want to cancel your flights yourself, FTI Touristik is currently unable to carry out either a cancellation or a refund.

Your motorhome booking
You have already paid FTI Touristik and want to pick up your motorhome in June: according to the motorhome rental company, your booking is still active and the reservation is maintained. Since your tour operator FTI Touristik has not (any longer) made an advance payment for your booking, the rental companies are forced ton to recalculate the rental price on site. As far as we know, this should be done in the amount of the rental price confirmed by FTI Touristik. (For reimbursement of the original payment, see 'What about your money?')
Please note that the contract offered to you for payment on site may not have the same services. For example, the additional liability insurance included in the rental price by FTI Touristik is not available in the USA/Canada.
You want to pick up your motorhome in July or later in 2024: according to the motorhome rental company, your booking is still active and the reservation will be maintained. Since the possible insolvency of the FTI Group became known, we at the travel agency have been in close contact with the motorhome rental companies in the USA/Canada and are working hard to continue to be able to guarantee your bookings. We may be able to do this with the help of another tour operator. We will keep you updated on this and will contact you automatically about this issue as soon as possible. In the event that you have already made payments for your previous booking(s), please read the information under 'What about your money' (below).
FTI Touristik regularly identifies motorhome bookings as 'package tours' in the booking confirmation. Read more about this below.

Your rental car booking
You have already paid FTI Touristik and want to pick up your rental car in June: according to the car rental company, your booking is still active and the reservation is maintained. Since your contractual partner FTI Touristik has not (any longer) made an advance payment for your booking, the rental companies are forced to charge you the rental price again on site. As far as we know, this should be in the amount of the rental price confirmed by FTI Touristik. (For a refund of the original payment, see 'What about your money?')

Your booked accommodation / rental car tour
You have booked accommodation or an individual rental car tour: Unfortunately, we have not yet received any specific information from the hosts as to whether your booked service(s) are still reserved for you. The bookings may be active, but not paid for by FTI Touristik. If you have already paid FTI Touristik, it can be assumed that the landlord will invoice you again for the room price on site.
Please note that accommodation booked as an individual service does not fall under the protection of insolvency insurance. This is different for bookings as a package tour (see there).
We are continuing to try to receive a status update on your accommodation bookings from FTI Touristik in order to give you a more concrete assessment of the situation. Once the situation has been clarified, we want to start preparing alternative offers for you as soon as possible and ask you to be patient at this point.

Cancellations and rebooking
Since the FTI Group's booking systems have been switched off since last weekend, neither bookings nor rebookings nor cancellations can be carried out technically since then.
If you have already sent us a cancellation request by email, it is automatically registered with us with the date and time, but cannot be carried out technically. As soon as there is an opportunity to do so, we will automatically forward your request to your contractual partner (e.g. FTI Touristik, FTI Touristik driveFTI or Cars&Camper, etc.). Please note in this context that the cancellation of a service is only possible under the conditions guaranteed in the travel contract (see General Terms and Conditions).
Due to the current situation, a refund/reimbursement of the amounts of money you have already paid to your contractual partner in connection with a cancellation request is currently not possible. Changes to this procedure can only be made by the insolvency administrator.

What about your money?
Have you already paid for your trip or parts of it? You have not paid to us, your travel agency, but directly to your tour operator or contractual partner. Since the payment page ('Paylink') of the FTI Group is currently offline, we cannot check whether your payments have been received there or whether (partial) claims still exist.
As a booking (arranging) travel agency, we naturally have no access to the accounting or bank details of the FTI Group. In this respect, it is not possible for us to confirm payments made by your contractual partner (e.g. FTI Touristik) to the service provider (e.g. vehicle rental company, accommodation, etc.).
If you have booked a package tour (see there), all payments you have already made are automatically covered by the insolvency insurance of the German Travel Insurance Fund (DRSF). Those affected should report any damage caused by additional or double payments directly to them and apply for reimbursement.

If you have not booked a package tour but individual services, you have the option of having your claim entered after the opening of possible insolvency proceedings directly through the insolvency administrator in the so-called 'insolvency list' (the list of all claims against the company).
You are free at any time and in any case to try to recall (partial) payments that have already been made. Depending on the payment method you have chosen on the FTI Group payment page (e.g. credit card, bank transfer, PayPal), your payment service provider may have procedures that you can use in such a case (e.g. 'charge-back', 'transfer recall', 'buyer protection').

Have you booked a package holiday?
According to the German Civil Code (BGB) ยง651, a package holiday is created by booking different travel services (e.g. flight, rental car, accommodation, etc.) at the same time with one contractual partner (e.g. FTI Touristik) for the purpose of the same trip. This will be visible to you when the offer is made through the transmission of pre-contractual information and when payment is made through the handing over of a security certificate that documents the security of your payments through insolvency insurance.
The travel registration/invoice issued by us or the booking confirmation/invoice from your contractual partner will provide you with information about the type of trip (e.g. package holiday) of your booking.
